These Terms and Conditions ("Terms") govern your use of the eòlas platform, operated by [REGISTERED ENTITY NAME] ("eòlas", "we", "us"). By creating an account or using eòlas, you agree to these Terms. If you do not agree, please do not use the service.

1. Acceptance of Terms

By registering for an account on eòlas, you confirm that you are at least 13 years of age (or have obtained parental/guardian consent if under 18), and that you accept these Terms and our Privacy Policy.

If you are registering on behalf of a school, department, or institution, you confirm that you have the authority to accept these Terms on behalf of that organisation.

2. The Service

eòlas provides an AI-powered assessment platform that marks student written submissions against SQA marking instructions. The service is provided "as is" and "as available". We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice where possible.

eòlas is intended for use in Scottish secondary education contexts. Use of the service outside this context is permitted but is not the primary design focus.

3. Account Registration and Security

• You must provide accurate, complete information when registering.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must notify us immediately if you suspect unauthorised access to your account.
• One person may not hold multiple accounts for the purpose of circumventing credit or usage limits.
• eòlas accounts are personal and non-transferable.

4. Educator Accounts

Educator accounts are available to teaching professionals and others with a legitimate educational purpose. By registering as an educator, you confirm that:

• You are using eòlas in a professional or educational capacity.
• You will only add students to projects with their knowledge and appropriate consent (and parental consent where required).
• You will review AI-generated marks before sharing results with students or parents, applying your own professional judgement.
• You will not share student data with unauthorised parties.

5. Student Accounts

Student accounts are free. Students may only be added to projects by their educator. By registering as a student, you confirm that you are using eòlas for legitimate educational purposes and that you have parental or guardian permission if you are under 18.

6. Parent and Guardian Accounts

Parent/guardian accounts are free and provide read-only visibility of linked student results. Access to a student's results is subject to the educator enabling parent visibility for the relevant project. Parent accounts may not submit work or access other students' data.

7. Credits and Payments

7.1 Credit system

The eòlas AI marking service operates on a credit basis. One credit is consumed for each AI assessment of a student submission. Credits are purchased by educators and held in their account balance.

7.2 Welcome credits

New educator accounts receive 5 complimentary credits on registration. These are provided at eòlas's discretion and may be adjusted or withdrawn for new registrations at any time.

7.3 Credit purchases

• Credits are purchased in bundles via Stripe. Payments are subject to Stripe's own terms of service.
• All prices are displayed inclusive of VAT where applicable.
• Credits are non-transferable between accounts.
• Credits have no cash value and cannot be exchanged for currency.

7.4 Refunds

Credits already consumed (i.e. used to generate an AI assessment) are non-refundable, as the AI processing cost is incurred at the time of assessment. Unused credits may be refunded at our discretion upon request within 30 days of purchase. Contact hello@failte.dev to request a refund.

8. AI Assessments — Limitations and Disclaimers

• AI-generated marks and feedback are produced automatically and may not be perfect. They should be treated as a starting point for educator review, not as a final authoritative assessment.
• eòlas AI assessments are not a substitute for professional teacher judgement. Educators bear responsibility for any marks they share with students or parents.
• eòlas is not affiliated with or endorsed by the Scottish Qualifications Authority (SQA). AI marking is based on publicly available SQA marking instructions and is independent of the official examination process.
• We make no warranty that AI marks will be identical to or equivalent to marks awarded by SQA markers in the official examination.

9. Intellectual Property

9.1 eòlas platform

The eòlas platform, including its software, design, and content (excluding user-submitted content), is the intellectual property of [REGISTERED ENTITY NAME] and is protected by copyright and other applicable laws.

9.2 Student submissions

You retain ownership of any content you submit to eòlas, including student essays and written work. By uploading content, you grant eòlas a limited, non-exclusive licence to process that content for the sole purpose of providing the assessment service.

9.3 Anonymised data

We may use fully anonymised, aggregated data (which cannot be used to identify any individual) to improve the eòlas platform and train or refine our AI models. No personally identifiable information or identifiable student work is used for model training.

10. Prohibited Use

You may not use eòlas to:

• Submit content on behalf of a student without their knowledge or consent.
• Attempt to circumvent, manipulate, or deceive the AI marking system.
• Upload content that is unlawful, abusive, harassing, defamatory, or otherwise objectionable.
• Reverse-engineer, scrape, or attempt to extract the underlying AI models or marking logic.
• Share login credentials with multiple individuals.
• Use the platform for commercial resale without prior written agreement from eòlas.
• Upload content that infringes third-party intellectual property rights.

11. Suspension and Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms.
• Are used for fraudulent or abusive purposes.
• Have been inactive for more than 24 months (with advance email notice).

You may close your account at any time via account settings or by contacting us. On closure, your personal data will be deleted in accordance with our Privacy Policy retention schedules. Unused credits will be forfeited upon account closure unless a refund is requested prior to closure.

12. Limitation of Liability

To the maximum extent permitted by law:

• eòlas is provided "as is" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service.
• Our total liability in connection with any claim arising from your use of eòlas shall not exceed the total amount paid by you to eòlas in the 12 months preceding the claim.
• Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts, except where other mandatory consumer protection laws apply in your jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified by email to registered users at least 14 days before they take effect. Continued use of eòlas after that date constitutes acceptance of the revised Terms.
