These Terms and Conditions ("Terms") govern your use of the eòlas platform, operated by [REGISTERED ENTITY NAME] ("eòlas", "we", "us"). By creating an account or using eòlas, you agree to these Terms. If you do not agree, please do not use the service.
By registering for an account on eòlas, you confirm that you are at least 13 years of age (or have obtained parental/guardian consent if under 18), and that you accept these Terms and our Privacy Policy.
If you are registering on behalf of a school, department, or institution, you confirm that you have the authority to accept these Terms on behalf of that organisation.
eòlas provides an AI-powered assessment platform that marks student written submissions against SQA marking instructions. The service is provided "as is" and "as available". We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice where possible.
eòlas is intended for use in Scottish secondary education contexts. Use of the service outside this context is permitted but is not the primary design focus.
Educator accounts are available to teaching professionals and others with a legitimate educational purpose. By registering as an educator, you confirm that:
Student accounts are free. Students may only be added to projects by their educator. By registering as a student, you confirm that you are using eòlas for legitimate educational purposes and that you have parental or guardian permission if you are under 18.
Parent/guardian accounts are free and provide read-only visibility of linked student results. Access to a student's results is subject to the educator enabling parent visibility for the relevant project. Parent accounts may not submit work or access other students' data.
The eòlas AI marking service operates on a credit basis. One credit is consumed for each AI assessment of a student submission. Credits are purchased by educators and held in their account balance.
New educator accounts receive 5 complimentary credits on registration. These are provided at eòlas's discretion and may be adjusted or withdrawn for new registrations at any time.
Credits already consumed (i.e. used to generate an AI assessment) are non-refundable, as the AI processing cost is incurred at the time of assessment. Unused credits may be refunded at our discretion upon request within 30 days of purchase. Contact hello@failte.dev to request a refund.
The eòlas platform, including its software, design, and content (excluding user-submitted content), is the intellectual property of [REGISTERED ENTITY NAME] and is protected by copyright and other applicable laws.
You retain ownership of any content you submit to eòlas, including student essays and written work. By uploading content, you grant eòlas a limited, non-exclusive licence to process that content for the sole purpose of providing the assessment service.
We may use fully anonymised, aggregated data (which cannot be used to identify any individual) to improve the eòlas platform and train or refine our AI models. No personally identifiable information or identifiable student work is used for model training.

You may close your account at any time via account settings or by contacting us. On closure, your personal data will be deleted in accordance with our Privacy Policy retention schedules. Unused credits will be forfeited upon account closure unless a refund is requested prior to closure.
To the maximum extent permitted by law:
These Terms are governed by the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts, except where other mandatory consumer protection laws apply in your jurisdiction.
We may update these Terms from time to time. Material changes will be notified by email to registered users at least 14 days before they take effect. Continued use of eòlas after that date constitutes acceptance of the revised Terms.
